This Privacy Policy describes how DeFelsko Corporation ("DeFelsko," "we," "us," or "our") collects, uses, discloses, and protects personal information in connection with our website at defelsko.com (the "Website"), our software applications PosiSoft Desktop and the PosiTector mobile application (together, the "Software"), and our cloud-based reporting and storage service at PosiSoft.net (the "Service"). The Website, Software, and Service are referred to collectively in this Policy as our "Offerings."

This Policy applies to personal information processed by DeFelsko in connection with our Offerings. It does not apply to information collected by third parties with whom we do not have a contractual relationship, or to information collected through channels outside our Offerings.

This Privacy Policy explains our personal information practices. Use of our Offerings does not, by itself, constitute consent to processing for which applicable law requires consent.

2. Data Controller

DeFelsko Corporation is the controller responsible for your personal information under applicable data protection laws, including the EU and UK General Data Protection Regulation (together, "GDPR"), the California Consumer Privacy Act as amended by the California Privacy Rights Act ("CCPA"), Canada's Personal Information Protection and Electronic Documents Act ("PIPEDA") and Quebec's Law 25, and other applicable privacy laws.

3. Personal Information We Collect

‍

The categories of personal information we collect depend on how you interact with our Offerings. This section describes each category, the sources, and how we use it.

3.1 Information You Provide to Us
  • Quote requests and contact forms. When you submit a Rapid Response or other inquiry form on the Website, we collect the information you provide, which typically includes your name, email address, company, country, and any details you include in your message.
  • PosiSoft.net account information. When you create a PosiSoft.net account, we collect your email address and a password (stored in hashed form). We do not require other personal information to create an account.
  • Email marketing subscriptions. If you subscribe to our mailing list, we collect your email address and any other information you choose to provide. Subscriptions are managed through Constant Contact (see Section 6).
  • Customer support communications. When you contact us for technical support or service, we collect the information you provide in your communication, including your contact details and the content of your inquiry.

3.2 Information Collected Automatically
  • Website log data. Our web servers automatically record standard log information when you visit the Website, including your IP address, browser type and version, operating system, the pages you request, referring and exit pages, and the date and time of your visit.
  • Cookies and similar technologies. We use a limited set of cookies on the Website, described in Section 5.
  • Google Analytics. We use Google Analytics to understand how visitors use the Website. Google Analytics collects information about your visits, including IP address (truncated where supported) and browsing behavior on our site. See Section 6 for details. We use Termly and Google Consent Mode to manage consent choices relating to Google Analytics, as described in Section 5.
  • Google Ads and conversion tracking. We use Google Ads, including conversion tracking and remarketing features. When you visit the Website, Google may set tracking cookies and collect information about your interactions with the Website, including your IP address and the pages you view, depending on your consent choices and the Consent Mode configuration. This information is used to measure the performance of our advertising, to build audiences for remarketing, and for Google's own advertising purposes. See Sections 5 and 6 for details.

3.3 Information from the Software

The Software (PosiSoft Desktop and the PosiTector mobile application) does not transmit personal information or usage data to DeFelsko during normal use. Crash reports and diagnostic information are handled by your device's operating system (Apple, Google, Microsoft), not by DeFelsko. Those operating system providers handle that information under their own privacy policies.

If you choose to use the Service, the Software transmits your measurement data and related files to your PosiSoft.net account, as described in Section 3.4.

3.4 Information Stored in the Service

PosiSoft.net stores the following on your behalf:

  • Measurement data uploaded from your DeFelsko gages through the Software.
  • Report templates you create or customize.
  • Project metadata, annotations, and other content you add to your measurements or reports.
  • Account authentication data (email and hashed password).
  • Basic access logs (timestamps, IP address, device type) for security and troubleshooting.

You control what data is uploaded to the Service. Measurement data and report content are treated as your data; we do not use them for any purpose other than providing and improving the Service to you, except as otherwise permitted by this Policy or applicable law. We may also create and use aggregated or de-identified information derived from this data for research, industry benchmarks, and product or service development, as described in Section 7 of the Software End-User License Agreement, provided the information does not identify you or any individual and its creation and use comply with applicable law.

4. Purposes and Legal Bases for Processing

If you are located in the EEA, the UK, or another jurisdiction that requires identification of a legal basis for processing, the following legal bases and requirements apply, as relevant:

  • Performance of a contract (GDPR Article 6(1)(b)): to create and maintain your PosiSoft.net account, to provide the Service, to respond to your quote requests, and to provide customer support.
  • Legitimate interests (GDPR Article 6(1)(f)): to operate and secure our Website and Service, to prevent fraud and abuse, to improve our products and services, to communicate with customers about their orders or inquiries, and for other reasonable business purposes. Processing based on legitimate interests must be necessary and proportionate, and our interests must not be overridden by your rights and freedoms.
  • Consent (GDPR Article 6(1)(a)): for non-essential cookies, analytics, advertising cookies (including Google Ads conversion tracking and remarketing), and email marketing communications. You may withdraw consent at any time, as described in Sections 5 and 8.
  • Legal obligations (GDPR Article 6(1)(c)): to comply with tax, export control, and other legal requirements applicable to our business.

5. Cookies and Similar Technologies

Our Website uses cookies and similar technologies. We use Termly to present cookie choices and manage consent preferences. We use Google Consent Mode to communicate consent choices to Google and adjust the behavior of Google Analytics and advertising tags.

The categories of cookies we use are:

  • Strictly necessary cookies. Required to operate core Website features such as the shopping cart and quote request functionality. These cookies do not require consent under EU and UK law.
  • Analytics cookies (Google Analytics). These cookies collect information about how visitors use our Website. You can manage these cookie preferences through the consent controls described above.
  • Advertising cookies (Google Ads, conversion tracking, and remarketing). These cookies allow us to measure the effectiveness of our advertising campaigns on Google and partner networks, and to serve remarketing advertisements to you on other websites. Advertising cookies involve the sharing of data with Google for its own advertising purposes. You can manage these cookie preferences through the consent controls described above.

Most web browsers allow you to refuse cookies or delete cookies through their settings. Doing so may affect the functionality of the Website.

6. Recipients and Third-Party Service Providers

We share personal information only as necessary for the purposes described in this Policy, with service providers supporting Website hosting, cookie consent management, and online forms, including quote requests, and, where applicable, payment processing, and with the following categories of recipients:

  • Amazon Web Services (AWS). We host the PosiSoft.net Service on AWS infrastructure located in the United States. AWS acts as our processor and is contractually required to protect your data and use it only to provide hosting services to us.
  • Constant Contact. We use Constant Contact to manage our email marketing lists and to send promotional emails to subscribers. Constant Contact acts as our processor for these activities.
  • Google (Google Analytics). Google processes Website analytics data on our behalf. Google's privacy policy is available at policies.google.com/privacy.
  • Google (Google Ads, conversion tracking, and remarketing). We use Google Ads for advertising and to measure the performance of our advertising campaigns. For these activities, Google processes your personal information as an independent controller for its own purposes (including Google's advertising business and the building of audience segments) and, for some activities, as a joint controller with DeFelsko. This is distinct from Google's role as our processor for Google Analytics. Information shared with Google in connection with advertising includes online identifiers, IP address, device information, and information about your interactions with our Website. You can learn more and manage Google's use of your information at myadcenter.google.com and policies.google.com/technologies/ads.
  • Professional advisors. We may disclose information to our attorneys, accountants, auditors, and insurers where necessary and under appropriate obligations of confidentiality.
  • Authorities and legal process. We may disclose personal information in response to lawful requests by public authorities, including to meet national security or law enforcement requirements, where required by law, regulation, court order, subpoena, or other legal process, or where we believe in good faith that disclosure is necessary to protect our rights, property, or safety, or the rights, property, or safety of others.
  • Business transfers. If DeFelsko is involved in a merger, acquisition, financing, reorganization, bankruptcy, receivership, sale of assets, or transition of service to another provider, personal information may be transferred as part of that transaction. We will use reasonable efforts to ensure the acquiring or successor entity agrees to honor the commitments made in this Policy, subject to applicable law.

We do not sell personal information for monetary consideration. We do, however, share personal information with Google for advertising purposes as described above. In California and other U.S. states where such transfers are treated as "sharing" or "sale" under applicable privacy laws, this disclosure to Google is subject to applicable opt-out rights, including those described in Appendix D. We do not disclose personal information to any other third party for its own marketing purposes.

7. International Data Transfers

‍

DeFelsko is based in the United States, and our Service and most of our processing activities take place in the United States. If you are located outside the United States, your personal information will be transferred to, stored, and processed in the United States.

The United States has data protection laws that differ from those in your country of residence, and U.S. authorities may in some circumstances have access to personal information processed in the United States. Applicable data protection laws may require a lawful transfer mechanism and additional safeguards for certain international transfers.

8. Your Rights

Depending on your jurisdiction of residence, you have some or all of the following rights with respect to your personal information:

  • Access. You have the right to request a copy of the personal information we hold about you.
  • Rectification. You have the right to request correction of inaccurate or incomplete personal information.
  • Erasure. You have the right to request deletion of your personal information, subject to certain legal exceptions.
  • Restriction. You have the right to request restriction of processing in certain circumstances.
  • Data portability. You have the right to receive your personal information in a structured, commonly used, machine-readable format, and to transmit it to another controller.
  • Objection. You have the right to object to processing based on legitimate interests or for direct marketing purposes.
  • Withdrawal of consent. Where we process personal information on the basis of your consent, you have the right to withdraw that consent at any time. Withdrawal does not affect the lawfulness of processing carried out before withdrawal.
  • Complaint to a supervisory authority. You have the right to lodge a complaint with the data protection authority in your jurisdiction if you believe we have violated applicable law.

To exercise any of these rights, contact us at the address in Section 2. We will respond to your request within the time required by applicable law (generally one (1) month under GDPR, which may be extended by up to two (2) additional months for complex or voluminous requests. We will inform you of any extension within the first month). Where permitted by applicable law, we may need to verify your identity before processing your request, and we reserve the right to deny requests that we cannot reasonably verify or that are excessive, repetitive, or manifestly unfounded. Sale or sharing opt-out requests do not require identity verification.

You will not be charged a fee for exercising your rights, except where a request is manifestly unfounded, excessive, or repetitive, in which case we may charge a reasonable fee reflecting the administrative costs of compliance or refuse to act on the request, as permitted by applicable law. You will not be discriminated against for exercising your rights.

9. Data Retention

‍

We retain personal information for as long as necessary to fulfill the purposes described in this Policy, unless a longer retention period is required or permitted by law. Specifically:

‍

  • Quote requests, support inquiries, and customer records: retained for seven (7) years from the date of the last interaction, to support ongoing customer relationships, warranty service, and compliance with tax and export recordkeeping obligations.
  • PosiSoft.net account data and uploaded measurement data: retained while your account is active. Following termination or closure of your account, User Data, as defined in the Software End-User License Agreement, is retained in its then-current form for at least thirty (30) days to allow you to export it, unless prohibited by law or by your instructions. After that period, it may be deleted from active systems, subject to retention in backups and archives for customary periods and retention required by applicable law. Other account records are retained only as necessary for the purposes described in this Policy, including any applicable customer-record retention described above.
  • Email marketing data: retained until you unsubscribe or request deletion.
  • Website log data: retained for a rolling period sufficient for security and troubleshooting, typically not exceeding twelve (12) months.
  • Analytics data: retained in accordance with Google Analytics default retention settings.

When we no longer have a lawful basis for retention, we will delete or anonymize the information in accordance with our data retention schedule. If deletion is not technically feasible (for example, in secure backup archives), we will securely isolate the information until deletion is possible. Notwithstanding the foregoing, we may retain information to the extent necessary to comply with legal obligations, resolve disputes, enforce our agreements, or protect our legitimate interests.

10. Security

‍

We maintain administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, alteration, and destruction. These safeguards include encrypted transmission of data between the Software and the Service, password hashing, access controls, and use of reputable hosting infrastructure. No method of transmission or storage is entirely secure, and we cannot guarantee absolute security. DeFelsko shall not be liable for any unauthorized access, use, or disclosure of personal information resulting from circumstances beyond our reasonable control, including but not limited to hacking, cyberattacks, or other criminal activity by third parties.

You are responsible for maintaining the confidentiality of your PosiSoft.net account credentials and for all activities that occur under your account. If you believe your account has been compromised, you must contact us promptly. DeFelsko shall not be liable for any loss or damage arising from your failure to protect your account credentials.

In the event of a security incident that affects your personal information, we will notify you and the relevant authorities to the extent required by applicable law. Nothing in this Policy shall be construed to require notification beyond what is legally mandated.

11. Children's Privacy

‍

Our Offerings are intended for professional and business use and are not directed at children. We do not knowingly collect personal information from children under the age of thirteen (13), or under the applicable higher age threshold in any jurisdiction where such a threshold applies (up to sixteen (16) under GDPR as implemented in certain EU member states). If you believe we have inadvertently collected personal information from a child, please contact us and we will take reasonable steps to delete it.

12. Automated Decision-Making

‍

We do not use your personal information to make decisions based solely on automated processing that produce legal or similarly significant effects on you.

13. Changes to This Policy

‍

We may update this Privacy Policy from time to time in our sole discretion to reflect changes in our practices, our Offerings, or applicable law. When we make a change, we will post the updated Policy on the Website and update the "Effective Date" above. Material changes remain subject to any additional notice or consent required by applicable law. You are responsible for periodically reviewing this Policy to remain informed of any updates.

In the twelve (12) months preceding the effective date of this Policy, we have collected the following categories of personal information, as defined by the CCPA. For retention periods applicable to each category, see Section 9 (Data Retention) of the main Policy.

  • Identifiers (name, email address, IP address, online identifiers, advertising identifiers): collected from Website forms, account creation, automatic Website logging, and advertising cookies.
  • Commercial information (purchase history, quote inquiries): collected from interactions with our sales and support teams.
  • Internet or network activity (browsing behavior on defelsko.com, interaction with the Service, response to our advertisements): collected automatically and through Google Analytics and Google Ads.
  • Geolocation data (approximate, derived from IP address): collected automatically.
  • Inferences (drawn from the above to build advertising audiences through Google Ads): developed from your interaction with our Website and advertisements.

We collect account log-in credentials (email address and a password stored in hashed form), which constitute sensitive personal information as defined by the CCPA, for account administration and security as described in Sections 3.1 and 3.4.

D.3 Sharing for Cross-Context Behavioral Advertising

We share the following categories of personal information with Google for purposes of cross-context behavioral advertising and measurement, which constitutes "sharing" under the CCPA:

  • Decline advertising cookies through the Termly consent controls on the Website, or revisit those controls to change your preferences.
  • Send your opt-out request to privacy@defelsko.com. Sale or sharing opt-out requests do not require identity verification.

To exercise your other CCPA rights (access, deletion, correction), contact us at privacy@defelsko.com or by toll-free telephone at 1-800-448-3835. We will confirm receipt of your request within ten (10) business days and will respond within forty-five (45) days, which may be extended by an additional forty-five (45) days where reasonably necessary. We will verify your identity before processing your request using reasonable methods, which may include requiring you to provide additional information to confirm your identity. We reserve the right to deny requests that we cannot reasonably verify. You may designate an authorized agent to make a request on your behalf, subject to our verification of both the agent’s authority and your identity.

D.6 Shine the Light

‍

California Civil Code Section 1798.83 permits California residents to request information regarding disclosures of personal information to third parties for their own direct marketing purposes. We do not disclose personal information to third parties for their direct marketing purposes.

You have the right to access and correct personal information we hold about you, and to complain about our handling of your personal information. Complaints should be sent to the address in Section 14. If you are not satisfied with our response, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.

E.3 Overseas Disclosure

As described in Section 7, we store and process personal information in the United States. Transfers and disclosures remain subject to applicable requirements of the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
